In the case of an intellectually disabled patient, the attending physician was restricted from writing a Do-Not-Resuscitate (DNR) order. Although the rationale for this restriction was to protect the patient from an inappropriate quality of life judgment, it resulted in a worse death than the patient would have experienced had he not been disabled. Such restrictions that are intended to protect intellectually disabled patients may violate their right to equal treatment and to a dignified death.

In Hume's Social Philosophy, Christopher J Finlay presents a highly original and engaging reading of David Hume's landmark text, A Treatise of Human Nature, and political writings published immediately after it, articulating a unified view of his theory of human nature in society and his political philosophy. The book explores the hitherto neglected social contexts within which Hume's ideas were conceived. While a great deal of attention has previously been given to Hume's intellectual and literary contexts, important connections can (...) also be made between the fundamentals of Hume's philosophy and the social world in which it was developed. Finlay argues that Hume's unified theory of human nature, conceived in terms of passions, reason and sociability, was meant to account for human nature in its most articulate manifestations, in the commercial and 'polite' social contexts of eighteenth-century Europe. Through careful exegetical study of Hume's analysis of reasoning and the passions, Finlay explores the diverse aspects of sociability which the Treatise of Human Nature invokes. In particular, this study finds in the Treatise an important exploration of the tensions between the selfish motivations of individuals and their propensity to bond with others in complex and diverse kinds of social group. Analysis of Book III of the Treatise and of essays published afterwards shows how the various individualist and social propensities explored through the passions are addressed in Hume's theories of justice, morals and politics. Kant actively struggles with the problem of how to conceive of God's creative action in relation to human freedom. He comes to the view that human freedom can only be protected if God withdraws in certain ways from the created world. The two pillars of Kant's mature philosophy - transcendental idealism and freedom - are in part shaped and motivated by Kant's need to provide a solution to his theological problem. The medieval and early modern theological tradition conceives of divine (...) action as unlike the action of any created being. When the creature acts, God directly causes this action, but without reducing the creature's freedom. Kant explicitly discusses and rejects this account of divine and human concursus. This rejection has significant and surprising ramifications for Kant's wider philosophy, explaining otherwise incomprehensible claims in his critical philosophy. Christopher J. Insole presents a definitive study in the history of ideas, engaging with a wide range of Kant's texts from 1749 until the early 1800s. Many of these texts have received little or no attention in Kant studies to date. Insole places Kant's thought in relation to numerous historical and traditional positions and illuminates these positions by a close engagement with recent debates in analytical philosophy and systematic theology. Kant is unrelentingly honest when grappling with the difficulty of relating divine and human freedom. This study, of Kant's theological struggle and legacy, goes to the heart of the problem in the modern reception of what the Christian tradition has affirmed about human freedom. For many Americans, the election of Barack Obama as the country's first black president signaled that we had become a post-racial nation - some even suggested that race was no longer worth discussing. Of course, the evidence tells a very different story. And while social scientists are fully engaged in examining the facts of race, normative political thought has failed to grapple with race as an interesting moral case or as a focus in the expansive theory of social justice. Political (...) thought's under participation in the debate over the status of blacks in American society raises serious concerns since the main academic task of political theory is to adjudicate discrepancies between the demands of ideal justice and social realities. Christopher J. Lebron contends that it is the duty of political thought to address the moral problems that attend racial inequality and to make those problems salient to a democratic polity. Thus, in The Color of Our Shame, he asks two major questions. First, given the success of the Civil Rights Act and the sharp decline in overt racist norms, how can we explain the persistence of systemic racial inequality? Second, once we have settled on an explanation, what might political philosophy have to offer in terms of a solution? In order to answer these questions Lebron suggests that we reconceive of racial inequality as a condition that marks the normative status of black citizens in the eyes of the nation. He argues that our collective response to racial inequality ought to be shame. While we reject race as a reason for marginalizing blacks on the basis of liberal democratic ideals, we fail to live up to those ideals - a situation that Lebron sees as a failure of national character. Drawing on a wide array of resources including liberal theory, virtue ethics, history, and popular culture, Lebron proposes a move toward a "perfectionist politics" that would compel a higher level of racially relevant moral excellence from individuals and institutions and enable America to meet the democratic ideals that it has set for itself. On Michael Walzer's influential account, "dirty hands" characterizes the political leader's choice between absolutist moral demands (to abstain from torture) and consequentialist political reasoning (to do what is necessary to prevent the loss of innocent lives). The impulse to torture a "ticking bomb terrorist" is therefore at least partly pragmatic, straining against morality, while the desire to uphold a ban on torture is purely and properly a moral one. I challenge this Machiavellian view by reinterpreting the dilemma in the framework (...) of the Humean theory of justice and moral sentiment. By interpreting the ticking bomb scenario as a dramatic narrative, I argue that it appeals to properly moral sensibilities, which speak in favour of the use of force against the terrorist. The absolute ban on torture, by contrast, is an artificial virtue and a product of political prudence. On this account, the ticking bomb terrorist dilemma therefore imposes a different burden on the political leader from Walzer's version: an ethic of political responsibility demands that the political leader be prepared to sacrifice her moral soul by upholding the law against moral but politically imprudent demands to break it; while the ticking bomb romance appeals to her feelings of compassionate moral concern towards particular individuals. She dirties her hands morally, not by authorizing torture, but by allowing the terrorist's bomb to detonate and take the lives of the innocent. (shrink)

From a corporate governance perspective, one of the most important jobs of a firm's top management team is to create and maintain a positive moral environment. Business ethics has long been considered a cornerstone in the field of strategic management and a number of scholars have called for more research in this area over the years. In this paper 658 articles that appeared in "Strategic Management Journal" over the 10-year period between 1996 and 2005 are reviewed for business ethics focus (...) and content. The results reveal that while business ethics research in "Strategic Management Journal" is on the rise, the overall focus on this research stream has been limited. The most prominent ethics theme during the review period was environmentalism, accounting for 30% of all ethics articles. Author affiliations, future research directions, and implications are also discussed. (shrink)

What role should a citizen's religious convictions play in her political activities? Is she, for example, permitted to decide on the basis of her religious convictions to support laws that criminalize abortion or discourage homosexual relations? Christopher Eberle is deeply at odds with the dominant orthodoxy among political theorists about the relation of religion and politics. His argument is that a citizen may responsibly ground her political commitments on religious beliefs, even if her only reasons for her political commitments (...) are religious in nature. His ideal of citizenship allows citizens to engage in politics without privatizing their religious commitments, and yet does not license mindless and intransigent sectarianism. An inherently controversial book that offers a substantial challenge to political liberalism, it will be read by students and professionals in philosophy, political science, law and religious studies, and general readers seeking insight into the relationship between religious commitments and liberal politics. Despite an increase in international business ethics research in recent years, the number of studies focused on Latin America and China has been deficient. As trade among Pacific Rim nations increases, an understanding of the ethical beliefs of the people in this region of the world will become increasingly important. In the current study 208 respondents from Peru and China are queried about their ethical ideologies, firm practices, and commitment to organizational performance. The empirical results reveal that Chinese workers are (...) more relativistic and less idealistic than their Peruvian counterparts. One explanation for the disparity between these two groups is likely the variation in collectivism that can be traced to different levels of importance across ingroups and outgroups. Although business ethics has a long history as a core theme within the realm of strategic management it has not received considerable attention in top strategy journals until recently. In this paper, we assess the state of business ethics research published over a 5-year period (2006–2010) in Strategic Management Journal to ascertain whether there has been an increase in business ethics research published in the top strategy outlet. The results of our content analysis reveal that ethics research in SMJ is (...) indeed on the rise yet this research stream is still underrepresented with only 5.8 % of all articles published over the five-year period having an ethics theme. Moreover, the link between Corporate Social Performance and Financial Performance was identified as the top theme during the review period. (shrink)

The relatively recent increase in empirical research conducted in business ethics has been accompanied by a growing literature which addresses its present shortcomings and continuing challenges. Particular attention has been focused on the difficulties of obtaining valid and reliable primary data. However, little or no attention has been paid to the use of secondary data. The aim of this paper is to stimulate the interest of business ethics researchers in using secondary data, either as a substitute or complement for primary (...) data, bearing in mind both the benefits and shortcomings of doing so. It is suggested that secondary data not only offer advantages in terms of cost and effort, as conventionally described in research methods books, but also that in certain cases their use may overcome some of the difficulties that particularly afflict business ethics researchers in the gathering of primary data. In order to help business ethicists respond to this call for greater consideration of the potential offered by secondary data, the wide variety of forms that such data may take is indicated and a number of themes regarding their use discussed. Recent debate on the relationship between cyber threats, on the one hand, and both strategy and ethics on the other focus on the extent to which ‘cyber war’ is possible, both as a conceptual question and an empirical one. Whether it can is an important question for just war theorists. From this perspective, it is necessary to evaluate cyber measures both as a means of responding to threats and as a possible just cause for using armed kinetic force. In this (...) paper, I shift the focus away from ‘war’ as such in order to ask whether some cyber threats might justifiably be characterized as a form of ‘violence.’ Some theorists argue that the term violence ought to be defined so as to encompass things like ‘structural’ harm or harm by neglect and thereby question implicitly the focus of just war theorists on armed force. This paper draws on a theory of violence I developed elsewhere as a defence of just war theory’s narrow understanding of violence. According to the ‘Double-Intent’ theory, a distinctive form of ‘Violent Agency’ is the factor uniting the category of violence while partly accounting for the peculiar moral connotations of the term. Here, I argue that the resulting definition of violence reshapes the category in a way that includes some forms of cyber-attack. This may help us to see where cyber might fit in relation to just war theory and the ethics of kinetic attack. (shrink)

Extinction is usually associated with the death of the last remaining individual of a species, taxon, or population of organisms. Here I ask the question of whether extinction might also be applied to cases where individuals of the relevant category remain alive. Global impacts in the Anthropocene suggest extinction may be broader than typically thought. Technologies available in the emerging ‘synthetic age’ alter taxa in ways that may appropriately be characterized as extinction. The core of the more traditional account of (...) extinction remains valuable. Losing the last few individuals of a taxon matters. But emerging types of loss may demand a broader understanding of extinction. This broader understanding could capture more of what humans are doing to the biosphere. (shrink)

In their meta-analysis Wood, Kressel, Joshi, and Louie argue little evidence supports shifts in mating preferences across the menstrual cycle. They imply this may represent a critical weakness of evolutionary psychology theories of mating preferences more generally. This report represents a fairly common use of meta-analysis: to assemble data to support or reject a particular proposition over which there is debate. Yet, rarely do meta-analyses succeed at resolving ideological debates. Multiple decision points related to the selection, coding, effect size extraction, (...) and interpretation of studies leaves considerable room for meta-analytic authors to interject their own beliefs. Meta-analyses are typically hailed by those who agreed a priori with their conclusion, and rejected as fatally flawed by those in disagreement. As such, meta-analyses have failed in replacing narrative reviews as more objective. (shrink)

The words 'rebellion' and 'revolution' have gained renewed prominence in the vocabulary of world politics and so has the question of justifiable armed 'resistance'. In this book Christopher J. Finlay extends just war theory to provide a rigorous and systematic account of the right to resist oppression and of the forms of armed force it can justify. He specifies the circumstances in which rebels have the right to claim recognition as legitimate actors in revolutionary wars against domestic tyranny and (...) injustice, and wars of liberation against wrongful foreign occupation and colonialism. Arguing that violence is permissible only in a narrow range of cases, Finlay shows that the rules of engagement vary during and between different conflicts and explores the potential for irregular tactics to become justifiable, such as non-uniformed guerrillas and civilian disguise, the assassination of political leaders and regime officials, and the waging of terrorist war against civilian targets. In 2011, Steven Pinker published The Better Angels of Our Nature: Why Violence Has Declined,1 arguing we are the beneficiaries of the "long peace." The problem with invoking long periods of peace is that they are often fleetingly ephemeral and can rapidly turn to hostility. The very year the book was published marked the beginning of the Arab Uprisings, unforeseen and unplanned for, apparently without historical precedent or analogy. The spiraling violence and polarization, as well as the accompanying refugee crisis (...) that has followed, have demonstrated this was a questionable, if not illusory designation. This article critiques the idea of instrumental justification for violent means seen in Hannah Arendt's writings. A central element in Arendt's argument against theorists like Georges Sorel and Frantz Fanon in On Violence is the distinction between instrumental justifications and approaches emphasizing the `legitimacy' of violence or its intrinsic value. This doesn't really do the work Arendt needs it to in relation to rival theories. The true distinctiveness of Arendt's view is seen when we turn to On Revolution and resituate (...) the later arguments of On Violence in the context of her ideas about the separation between revolution and liberation. Arendt's commitment to the American discovery in revolutionary politics of a means that needs no further ends to justify it permits a rereading of her conception of liberation as an attempt to envisage a violence that, while tactically instrumental, is at the same time politically non-instrumental. But while Arendt's view is distinct, the article also highlights important thematic continuities with the writings of Sorel and Walter Benjamin. (shrink)

Without denying the importance of a range of independent epistemic and metaphysical considerations, I argue that there is an irreducibly theological dimension to the emergence of Kant's transcendental idealism. Creative tasks carried out by the divine mind in the pre‐critical works become assigned to the human noumenal mind, which is conceived of as the source of space, time and causation. Kant makes this shift in order to protect the possibility of transcendental freedom. I show that Kant has significant theological difficulties (...) ascribing such transcendental freedom to creatures in relation to God, and that he intends transcendental idealism to be a solution to these difficulties. I explain how this provides Kant with a powerful motivation and reason for denying the so‐called “neglected alternative”, and conclude by suggesting that the nature of any theological response to Kant will depend upon some fundamental options about how to conceive of the relationship between the creator and creation. This investigation will involve a selective examination of seventeenth-century writings before looking at again selective Enlightenment texts. The essay is deliberately wide ranging, but it aims to pick out the emergence or crystallization of political economy by noting how theorists sought to establish it as a subject matter and in the process develop ways of studying it that aimed to uncover regularities and exhibit generality, systematicity, and (...) precision. Together these supported its pretensions or claims to be a science that would in a Baconian manner be useful and free of the perceived shackles of a moralistic classical disparagement of economic activity. I begin this essay by articulating an argument in support of the claim that theistic citizens ought not to support coercive policies for which they lack an adequate secular rationale. That argument employs various claims regarding God's nature to show: (i) that theistic citizens should expect to discern secular corroboration for each religiously grounded moral truth to which they adhere; and (ii) theistic citizens should doubt any religiously grounded moral claim for which they cannot discern an adequate secular rationale. I (...) dispute both (i) and (ii) and conclude that theistic citizens may reasonably reject the claim that they ought not to support coercive policies for which they lack an adequate secular rationale.
